Welcome to THEJNSREPORT’S: Corporate Tyranny vs The Working Class
Written by T.D Moody
Recently, I heard about a situation occurring with someone I know that left a very unsavory taste in my mouth and fire in my belly . We all know that jury duty summons’ are a pain in the ass because most of the working class can’t afford to lose a day’s pay for $40 pre tax.
Well listen to this, recently someone I know (who has been with her job for over 18 years) received a jury duty summons and immediately notified Human Resources at work of the summons and submitted a copy of it to the HR department inquiring about compensation during jury service.
Human Resources then stated to this person that as an “exempt” employee as long as one hour of work per week was completed the person’s full weekly salary would be paid for the duration of the jury service period.
Low and behold this employee is selected from among the jury pool to serve on a jury case which is to last four to five months. After several weeks of jury service and receiving salary, the supervisor of this employee came to present three options to choose from with regards to her continuing to receive her weekly salary.
Astonishment, anger and dumbfounded were some of the adjectives used to describe what she felt upon reading the three options her supervisor was presenting on behalf of the company’s President/CEO. Bare in mind that this person would be at trial 4 days a week and worked Friday’s and holidays while still serving jury duty.
Here are the three options she was given to choose from:
Option 1 : Work every Saturday and Sunday for the duration of jury duty service.
Option 2: Take an unpaid leave of absence for the remainder of the jury duty service period.
Option 3: Work on Fridays only and only be paid for Fridays.
I immediately became incensed upon fully grasping what she had just revealed to me. Both her and my first question was, is this legal? Well friends this is where doing homework and checking policies and the law with regards to jury duty becomes invaluable. According to http://www5.cbia.com
Waiver of Jury Service Compensation
Employers may submit a written request to the court in which the juror served to waive the requirement to pay an employee for jury service if payment would result in extreme financial hardship to the employer. Small employers, in particular, have successfully taken advantage of this provision.
The request must be made within fifteen days of receiving the waiver application, which is provided to the juror upon completion of service. If the employer is excused from its obligation to pay an employee, the court will reimburse the juror’s regular wages for up to $50 per day. If a waiver application is denied, the employer may apply for a hearing within 20 days from the court finding.
Employers’ Failure to Pay Wages
Under state law, employers who have not obtained a waiver and who fail to pay an employee serving on a jury may be liable for treble damages and attorneys’ fees. If a juror sues the employer under these circumstances, extreme financial hardship is not permitted as a defense.
Employers’ Obligations – Federal Courts
Federal law does not require employers to pay their non-exempt employees’ wages for jury duty. Employers are, however, required to (1) consider employees on a leave of absence during jury service; (2) continue their insurance and other benefits according to established leave of absence policies; and (3) reinstate employees to their positions without loss of seniority. Federal jurors are paid $40 per day and, in most courts, reimbursed for reasonable transportation and parking expenses.
Employers’ Personnel Policies
Although not required to by law, many employers also pay the difference between jury duty pay and the employee’s regular wages. If your company has an employee handbook, it’s a good idea to include your jury duty policy in it to ensure that the policy is applied consistently.
Prohibited Actions by Employers
Both state and federal law prohibit employers from discharging, threatening or coercing employees who are summoned for jury duty or who are subpoenaed as witnesses in court proceedings.
Employers may be fined up to $500 or imprisoned up to thirty days or both under state law and fined up to $1,000 per violation under federal law. In addition, employees who are discharged in violation of this law may seek reinstatement, lost wages and reasonable attorneys’ fees from the employer.
I then checked http://www.nyjuror.gov/pdfs/hb_EE.pdf and found a guide for the State of NY on jury duty to further consolidate my understanding of what is legal and illegal with regards to employers responsibilities per jury duty and their employees.
The following is what I found.
Employers’ Obligations
Must employers allow employees to serve? Yes. An employer must allow employees time off from work to
serve as jurors. An employer who discharges or penalizes an employee for serving as a juror may be prosecuted by the Office
of the Attorney General and subjected to criminal penalties.
May an employer change an employee’s regularly scheduled hours of work when the employee is scheduled to serve as a
juror?
Schedule changes that are designed to accommodate the employee’s obligation to serve are permitted. Schedule changes
that penalize an employee may result in prosecution by the Office of the Attorney General and criminal penalties.
May an employer require an employee to take vacation or other paid leave while serving?
No. It is an illegal penalty to force an employee to charge jury duty absence against vacation, personal or sick time. However,
an employee may choose paid leave over losing wages.
An employer who penalizes an employee for service as a juror by forcing the juror to use paid leave may be prosecuted by the
Office of the Attorney General and subjected to criminal
penalties.
May an employer require an employee who serves as a juror to make up time?
No. An employer who forces an employee to work on days when the employee is not normally scheduled to work in order to
make up for time lost as a result of jury service may be prosecuted by the Office of the Attorney General and subjected
to criminal penalties.
After reading the above she drafted a response letter to her supervisor and employer requesting that the three options given to her be put into writing on company official letterhead so that she could submit it to the judge. She’s still waiting for a response. LOL
Welcome to THEJNSREPORT’S: The Morning after Halloween
So this morning I awake face down on my bed from a night out with friends/coworkers where I remembered bits and pieces of the night. Some bits I recall involve my friend the “Pope” saying “and the lord said let there be Jaeger and there was Jaeger and it was good.
And the lord said drinketh thy Jaeger and we drinketh the Jaeger.” LOL. Now mind you I didn’t actually drink any Jaeger but my friend the “Pope” sure did.
One moment I definitely remembered involved being ignored by a bartending “witch” dressed up in all black refusing to acknowledge my presence standing there patiently waiting for service after having just arrived at this particular bar.
I didn’t want to believe it was happening deliberately until my friends girlfriend who was came along with us to have a few drinks, said she would never even come to this particular sports bar (which shall remain nameless) alone or of her own volition because of the preferential treatment towards white customers vs minority customers.
I said to her are you sure? I suggested we both go to the bar together to see what would happen. The two of us stand together in the middle of the bar waiting for the bartender “witch” to look at us. Not once did she acknowledge our presence let alone make eye contact with us during the several trips she made back and forth behind the bar. Instead she walked right past us and talked to the customers who already had drinks.
I looked at my friend’s girlfriend and said wow! She replied “see I told you it isn’t just me.” Finally a male bartender noticed us and took our order for 2 Fireball shots.
We tipped this bartender well and ordered a second round just in time for the female bartender to take note of the coin we just dropped on the bar for 4 shots. It was only then that she decided the next time that we approached the bar to ask us if we needed something. How sweet karma is. I told her no it’s okay, the other guy has us.
That was probably the most satisfying moment of the night. Someone who initially wanted nothing to do with us only had the inkling to offer service when she saw the good money being spent plus hefty tip. She bypassed us and in doing so passed up on the opportunity to get good tips. Meanwhile the bartender who gave us prompt and courteous service got the coin.
Welcome to THEJNSREPORT’S: Dealing with Reality
Over the past few weeks I’ve come face to face with the realization of just what faces many of America’s youth today (myself Included) and it frightens me. Aging in this world where nothing is what it seems, and knowing exactly how to plan or prepare for the future seems antiquated and depressing. For many friends and some family members of mine, finding work in today’s economy has become a task filled with stress, frustration, and ultimately depression.
When I was a kid my parents kept drilling into me and my siblings heads that we go to school, stay on our books, and get a good job when we graduated. The problem with that mode of thinking, I’ve found is while being educated is definitely better than not, the cost of education has gotten so out of control and the lack of high paying or even living wage jobs is such that the advice given by my parents no longer applies.
Quite frankly, it hasn’t applied for much longer than I think most people realize. I listened to my parents got decent grades, graduated from school only to find that there were no jobs when I finished college. I took whatever was available to me back then and hoped things would get better.
Years have flown by and now my younger siblings, nieces, and nephews are finding out just how hard it is to get by these days especially living in NYC. Everything costs more and more as the value of the U.S. dollar steadily declines. I’ve had jobs I never thought in a million years I’d end up having just to put food on the table and keep clothes on my back. Then there’s the health insurance costs. Staying healthy is where the real wealth is.
I’m not quite sure how “ObamaCare” will work or benefit us all in the long run but I do know that right now it’s critical that one has a skill/trade that can be used to make money because (personally) long gone are those old days of taking out large amounts of money on student loans for job fields that don’t pay even half what the educational costs are for those choosing to pursue higher education degrees.
It’s like degrees for what? There are no jobs when you’re done, unless you plan to create your own business or happen to find work in a high paying high demand field like nursing. Sick people are big business. And everything appears to be a hustle.
Welcome to THEJNSREPORT’S: City Cakes Episode 2: More Cookies!!

In episode one I introduced several of the half pound monster cookies that City Cakes makes. This time around I bring the aforementioned Signature Sugar Doodle Cookie, and a big ole Chocolate Chip.

Looks like CupCake Wars has a potential new contestant.

The City Cakes Signature Sugar Doodle Cookie.

City Cakes take on The Classic Chocolate Chip Cookie.

Not from City Cakes but a friend who gave me a sample of this amazing treat!
That’s baklava a friend gave me over the weekend. Absolutely delicious! I mean it boggles the mind how someone came up with this creative brilliance of a desert. Admittedly, I don’t know what’s in baklava but I’ll soon find out. One thing I know is this was simple looking but outstanding!!
As for City Cakes it is my new favorite bakery. The Signature Sugar Doodle Cookie words can’t begin to explain how good it tastes. The Chocolate Chip cookie is equally as brilliant and both are must tries. At some point I’m gonna have to test their skills when I need another custom cake made. Then we’ll see how they do vs say Make my Cake.
Welcome to THEJNSREPORT’S: Spice Revisited
Another weekend has come to an end and as such I decided to treat myself to Spice Restaurant’s Drunk Man Noodles (spicy) w/shrimp and curried chicken puffs. There’s just something magical about broad rice based noodles. Mmmm Mmmm!!!

Looks like a Halloween themed curry puff or somebody done messed up. In either case it’s gonna get eaten.

Whether they call the place SEA or SPICE the food is all good. Best Thai food I’ve had in the city to date.
Welcome to THEJNSREPORT’S: CITY CAKES “DA COOKIES!!!!” Episode 1 Located at 251 West 18th St. Lower level
City interior is on the very small side but what they don’t have in size they more than make up for with the quality of their baked goods I assure all. By late afternoon I had a craving for a decadent desert and cookies were it.
Let’s see what’s inside the box…

Behold the shear magnanimity of them. These cookies are extra big. Pretty much the size of a Sumo Burger Pattie and I love it!

One by one these decadent delights made their way outside of the box to hit the runway before their sampling…Ladies & Gentleman I give you Triple Chocolate Spice (Say that 3 x s fast.), Oatmeal Raisin “UFO” and Reese’s Pieces Peanut Butter. Triple Chocolate had an accident in the box and so her lower left corner had broken off.

I don’t know if your ready for what I’m about to show you Neo. Behold the Oatmeal Raisin UFO.

Reese’s Pieces baked into just about every bite of this amazing piece of sweet goodness!
Now then where’s my lactaid?

You just might need two hands to pick up this Cookie.

There was one cookie missing from this exhibition the City Cakes Signature Sugar Doodle Cookie, which has Cinnamon sprinkled on it. Good God it’s an outrageous out of this world great cookie!!!
As you can see they are big cookies but are firm on the outside yet soft in the middle. As for the taste…look here, City Cakes has become my new favorite backery for Cookies!!!! It’s official. I think it safe to say these are the best damn cookies in the city.
One bite into each of these incredible variants and feelings of uncontrollable happiness overwhelmed me as my tastebuds clapped in rawkus applause. Each round of applause increasingly louder with the sampling of each cookie. All I can say is let your inner “Cookie Monster” out and let have with these. City Cakes I’ll be back and I won’t be coming alone. 😉
